Terms of Service for electronic services of Handyman24
These Terms set out the rules for using the Handyman24 website and application (the “Platform”). They are made available free of charge before a contract is concluded, in a form that allows them to be retrieved, reproduced and stored (Art. 8 of the Polish Act of 18 July 2002 on providing services by electronic means).
The Polish-language version of these Terms is legally binding. This translation is provided for information only.
§ 1. Definitions
- Provider / Operator — Oleksandr Chumakov, ul. Zbigniewa Herberta 37 lok. 2, 05-120 Legionowo, NIP 5361994183, e-mail: kontakt@handyman24.eu, operating the Platform.
- Platform — the Handyman24 website and app at https://handyman24.eu.
- Client — a User ordering repair/installation services, including a Consumer.
- Master (Contractor) — a User offering services via the Platform, either as a business or a private individual.
- Service Contract — a contract concluded directly between the Client and the Master.
§ 2. Type and scope of electronic services
- The Operator provides: account management, tools to publish Orders and submit Offers, matching of Clients with Masters, payment handling, messaging, reviews and notifications.
- The Operator is an intermediary (hosting provider). It is not a party to the Service Contract between Client and Master and does not perform repair/installation work.
§ 3. Technical requirements
A device with Internet access, a current browser with JavaScript and cookies enabled, and an active e-mail account.
§ 4. Registration and Account
True data and acceptance of these Terms and the Privacy Policy are required. Login credentials must not be shared.
§ 5. Orders, Offers and choosing a Master
Clients publish Orders; Masters submit Offers with their own, independently set price. The Client chooses an Offer; acceptance forms the Service Contract directly between Client and Master. The Master independently decides which Orders to accept, when and at what price.
§ 6. Master status (business / private individual)
Each Master declares whether they are a business or a private individual; the status is shown to the Client before contracting. If the Master is not a business, consumer-protection law does not apply to the Service Contract, and the Client is clearly informed of this.
§ 7. Payments, Commission and Wallet
Payments are processed by an external payment provider (Stripe); the Operator does not store card data. The Operator charges a Commission disclosed before the transaction. Prices are in PLN and include applicable taxes unless stated otherwise.
§ 8. Right of withdrawal (Consumer)
A Consumer may withdraw from a distance contract within 14 days without giving a reason. If the Consumer requested that performance begin before the withdrawal period expired and then withdraws, they must pay proportionally for the part already performed. The Consumer owes nothing if they were not informed of the right of withdrawal or did not request early performance. The request and acknowledgement of loss of the withdrawal right are confirmed on a durable medium (e-mail).
§ 9. Reviews
Only Clients who completed an Order with a given Master via the Platform may post reviews, ensuring reviews come from people who actually used the service. Fake reviews are prohibited.
§ 10. Ranking (placement)
The main parameters determining the order in which Masters are presented are described in “Transparency & ranking”. Paid placements are clearly labelled.
§ 11. User content and reporting
Unlawful content is prohibited. Anyone may report content via the “Report content” mechanism; decisions are reasoned and may be appealed.
§ 12. Complaints
Complaints about the Operator’s electronic services may be sent to kontakt@handyman24.eu and are handled within 14 days, with the outcome confirmed on a durable medium. Complaints about the performed work are addressed to the Master as the party to the Service Contract.
§ 13. Out-of-court dispute resolution (ADR)
Consumers may use out-of-court dispute resolution; information about competent entities is available from the President of UOKiK (uokik.gov.pl). ADR is voluntary.
§ 14. Operator liability
The Operator is responsible for the proper provision of electronic services and is not liable for the quality or conformity of work performed by Masters acting on their own account. Mandatory consumer rights are not limited.
§ 15. Personal data
Processing is described in the Privacy Policy; cookies in the Cookie Policy.
§ 16. Termination and account suspension
Users may delete their Account at any time. The Operator may suspend or block an Account for breaches; such decisions involve a human, are reasoned, and may be appealed.
§ 17. Changes
Changes are announced in advance and do not affect acquired rights.
§ 18. Final provisions
Polish law applies, subject to mandatory consumer-protection rules of the Consumer’s habitual residence. The Polish version of these Terms prevails.
